Copyright Rules
The Copyright act of 1976 governs the use of
copyrighted materials by teachers and students as well as allows for Fair Use of
these materials.
Fair Use
applies only to items that students or teachers create for educational or
instructional use; not personal use. In brief it states:

Teacher created items may be used
for up to two years after the first instructional use.
·
Copied materials may only be used
for one course term.
·
Student examples of work may be kept
in portfolios for any length of time.
·
Video taped from television
programs may only be used for up to 10 days from the original broadcast.
(this is one to remember!)
Internet:
·
It is permissible to create a link
to another website (unless the site has a statement telling you not to) and to
use copyrighted information in multimedia presentations (for educational
purposes and with the source cited)
·
It is not permissible to copy
information from one website to another
Text and Data:
There are very specific limitations here. Briefly:
·
Up to 10%, but not more than 1000
words from a single copyrighted work
·
Up to 250 words of a poem, or 3
poems by a single poet or 5 poems from a single anthology
·
Up to 10%, but not more that 2500
fields or cells, from a data table or base
Illustrations and Photographs:
·
A photo or illustration may be used
in its entirety and must display creators name.
·
No more than 5 images by a single
artist or photographer
·
Up to 10%, but not more than 15
images from a singe published collection
·
One picture, chart, cartoon, diagram
or graphic per source
·
You cannot change the basic melody
or fundamental character
·
Up to 10%, but no more than 3 min.
or single motion media
·
Up to 10%, but no more than 30
seconds from single musical work
·
Performance rights must be purchased
to use in public (all those end of the year slide shows!)
Citing of Ownership
·
Can be in a bibliography or list
from, except illustrations or photographs
